1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of heritage luxury car rental services provided by gallivamos ("Company," "we," "our," or "us"), operating from 1 Fullerton Road, #02-08, Singapore 049213.

By making a reservation, using our services, or accessing our website, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and gallivamos under Singapore law.

2. Definitions

Throughout these Terms:

• "Service" refers to all luxury car rental services, concierge support, and related offerings provided by gallivamos
• "Vehicle" means any heritage or classic automobile made available for rental
• "Rental Period" refers to the agreed timeframe from vehicle collection to return
• "Reservation" means a confirmed booking for Service
• "Agreement" means these Terms together with any rental contract and supplementary documentation

3. Eligibility Requirements

3.1 Age and Licence

To rent a Vehicle, you must:

• Be at least 25 years of age at the time of rental
• Hold a valid Singapore driving licence or recognized international driving permit
• Have a minimum of three years driving experience
• Possess legal capacity to enter into binding contracts under Singapore law

3.2 Verification

We reserve the right to verify your identity, driving credentials, and other information before confirming any Reservation. Failure to provide accurate information may result in rental refusal without refund of any deposits paid.

4. Reservations and Payments

4.1 Booking Process

Reservations may be made through our website, telephone, or email. A Reservation is confirmed only when you receive written confirmation from us and required payments have been processed.

4.2 Payment Terms

All prices are quoted in Singapore Dollars (SGD). Payment structure:

• 50% deposit required upon Reservation confirmation
• Remaining balance due 7 days before rental commencement
• Refundable security deposit collected at vehicle collection (amount varies by service tier)
• Additional charges (fuel, parking, excess mileage) settled at vehicle return

4.3 Accepted Payment Methods

We accept major credit cards (Visa, Mastercard, American Express) and bank transfers. Payment processing may involve third-party services subject to their own terms.

4.4 Pricing

Quoted prices include comprehensive vehicle coverage, standard mileage allowance, and stated service inclusions. Prices do not include fuel, parking fees, or additional services unless specifically stated. We reserve the right to adjust pricing with 30 days notice for future bookings.

5. Vehicle Use and Responsibilities

5.1 Permitted Use

You agree to:

• Operate the Vehicle only on paved roads within Singapore
• Comply with all Singapore traffic laws and regulations
• Use the Vehicle in a careful and responsible manner appropriate to its heritage character
• Allow only authorized drivers (listed on rental agreement) to operate the Vehicle
• Conduct pre-drive checks as instructed during vehicle orientation

5.2 Prohibited Activities

You must not:

• Operate the Vehicle while under the influence of alcohol, drugs, or medication affecting driving ability
• Use the Vehicle for racing, competitions, or any commercial purposes without prior written approval
• Sublet, lend, or otherwise provide the Vehicle to third parties
• Transport passengers beyond the Vehicle's stated capacity
• Operate the Vehicle in an abusive or negligent manner
• Make any modifications or alterations to the Vehicle
• Use the Vehicle outside Singapore without prior written authorization

5.3 Maintenance and Damage

You must:

• Report any mechanical issues immediately to our technical team
• Report any accidents or damage immediately to both us and Singapore authorities where required
• Not attempt repairs without our authorization
• Return the Vehicle in the same condition received, allowing for normal wear

6. Coverage and Liability

6.1 Included Coverage

Comprehensive coverage is included in all rentals, providing protection for:

• Collision damage to the Vehicle
• Third-party property damage and bodily injury
• Theft protection

6.2 Excess and Exclusions

Coverage is subject to an excess amount specified in your rental agreement. Coverage does not apply to:

• Damage resulting from prohibited activities outlined in Section 5.2
• Damage to non-Vehicle property in your possession
• Personal injury or property of passengers
• Damage from wear and tear or gradual deterioration
• Loss of Vehicle keys or accessories

6.3 Your Liability

You remain liable for the excess amount and any damages not covered by the included coverage. You are responsible for all fines, penalties, and charges incurred during the Rental Period.

7. Cancellation and Refund Policy

7.1 Client Cancellations

Cancellation charges apply as follows:

• More than 14 days before rental: Full refund minus 10% administrative fee
• 7-14 days before rental: 50% refund of total booking value
• Less than 7 days before rental: No refund

7.2 Rescheduling

Requests to reschedule made more than 7 days before the original rental date will be accommodated subject to availability. Rescheduling within 7 days may be possible at our discretion and may incur additional charges.

7.3 Event Bookings

Special occasion and concierge services have separate cancellation terms agreed during the planning phase, reflecting the bespoke preparation involved.

7.4 Force Majeure

If circumstances beyond reasonable control prevent service delivery (severe weather, government restrictions, vehicle mechanical failure), we will work with you to reschedule or provide a full refund.

8. Intellectual Property

8.1 Our Content

All website content, service materials, route books, and branding remain our property or that of our licensors. You may not reproduce, distribute, or create derivative works without written permission.

8.2 Photography and Testimonials

If you provide testimonials or allow us to photograph Vehicles during your rental, you grant us a non-exclusive license to use such materials for marketing purposes. You may request removal at any time.

9. Disclaimers and Warranties

9.1 Service Provision

While we strive to maintain Vehicles to the highest standards, heritage automobiles have unique characteristics. We do not guarantee:

• Uninterrupted availability of any specific Vehicle model
• That Vehicles will be completely free from minor imperfections consistent with their age
• Specific performance characteristics beyond general operational capability

9.2 Technical Support

We provide technical support during business hours. For emergencies outside these hours, contact information for roadside assistance is provided with each Vehicle.

9.3 No Professional Advice

Information and recommendations provided by our team are based on experience but do not constitute professional advice. You should exercise your own judgment regarding routes, timing, and activities.

10. Limitation of Liability

To the maximum extent permitted under Singapore law:

• Our total liability for any claim arising from your use of our Services shall not exceed the total amount paid by you for the relevant Reservation
• We are not liable for indirect, consequential, or special damages including lost profits, business interruption, or emotional distress
• We are not liable for delays or failures resulting from circumstances beyond our reasonable control

This limitation does not affect liability that cannot be excluded or limited under Singapore law, including liability for death or personal injury caused by negligence.

11. Indemnification

You agree to indemnify and hold harmless gallivamos, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your breach of these Terms
• Your violation of any law or third-party rights
• Your use of the Vehicle in a manner inconsistent with these Terms
• Any fraudulent or criminal activity

12. Termination

We may terminate a rental and require immediate Vehicle return without refund if:

• You breach these Terms
• You provide false or misleading information
• The Vehicle is at risk due to your actions or circumstances
• You engage in prohibited activities

Upon termination, you must return the Vehicle immediately to our location or a location we specify. You remain liable for all charges up to termination and any additional costs we incur.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Singapore. The Singapore courts have exclusive jurisdiction over any disputes arising from these Terms or your use of our Services.

13.2 Informal Resolution

We encourage you to contact us at [email protected] to resolve any concerns informally before pursuing formal dispute resolution. We commit to responding within 7 business days and working toward mutually acceptable solutions.

14. General Provisions

14.1 Entire Agreement

These Terms, together with your rental agreement and our Privacy Policy, constitute the entire agreement between you and gallivamos regarding our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms. We may assign our rights and obligations without restriction.

14.5 Notices

All notices must be in writing and sent to the addresses provided in Section 15. Email notices are deemed received when acknowledged.

15. Changes to Terms

We may modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our Services after changes constitutes acceptance. Material changes affecting existing Reservations will not be applied retroactively without your consent.
